Comprehensive Estate Planning, Wills & Trusts
Our goal at Legacy Law, LLC, is to help clients create a well-structured estate plan that reflects their values and goals. We offer a range of services tailored to meet each client’s unique legal needs, including but not limited to:
Wills
A will is a legal document that outlines how a person's assets are distributed after death. To be valid, it must be in writing, signed by the testator (age 18+ and of sound mind), and witnessed by two people. After death, the will goes through probate, where the court oversees its execution.
An executor manages assets, pays debts, and distributes property. If there's no will, state laws determine who inherits. Massachusetts also provides certain protections for spouses and minor children, ensuring they receive part of the estate.
Trusts
A trust is a legal arrangement where a grantor transfers assets to a trustee to manage for beneficiaries. Trusts can be revocable (modifiable) or irrevocable (fixed, with asset protection benefits). They help avoid probate, provide estate and tax planning advantages, and ensure assets are managed according to the grantor's wishes.
Power of Attorney
A Power of Attorney (POA) allows a person (the principal) to appoint someone (the agent) to make financial or legal decisions on their behalf. It must be signed before a notary public and remains in effect if the principal becomes incapacitated. The principal can revoke a POA at any time if competent, and it generally ends upon their death. POAs are commonly used for estate planning, elder care, or temporary decision-making authority.
Health Care Directives
A Health Care Proxy lets a person (the principal) appoint someone (the agent) to make medical decisions if they become unable to do so.
It must be signed before two adult witnesses and takes effect only if a doctor determines the principal cannot make decisions. The agent follows the principal's medical wishes, and the proxy remains valid unless revoked.
